GREENFIELD — A Monterey County judge sentenced Miguel Rubio, 42, of Greenfield, to 25 years in prison for committing three counts of forcible lewd acts upon a child under 14.
“These offenses are serious and violent felonies and considered strikes under California’s Three Strikes law,” stated the Monterey County District Attorney’s Office in a news release Jan. 8. “Rubio will also be required to register as a sex offender for the rest of his life.”
According to the DA’s Office, Jane Doe 2 reported that Rubio, a family member, had been sexually assaulting her for many years and touched her “intimate areas over her clothing starting when she was in seventh grade.” Doe 2 disclosed that the sexual assaults continued until she left for college.
“Jane Doe 2’s brave disclosure to law enforcement resulted in Jane Doe 1 and Jane Doe 3 also reporting that Rubio had sexually assaulted them,” stated the DA’s Office. “Jane Doe 1 reported that Rubio touched her intimate areas numerous times over the clothing while she was sleeping beginning when she was 12 years old. Jane Doe 3 reported that Rubio touched her breasts over the clothing one time when she was a freshman or sophomore in high school.”
All the victims reported being afraid of Rubio because he was physically and verbally abusive toward them and other family members. The victims stated they delayed reporting because they were “afraid of Rubio and were worried about breaking up their family,” according to the release.
“According to research into sexual assault victim behavior, it is very common for victims to delay reporting the sexual abuse, especially when the victim is a minor and has a close relationship with the perpetrator,” added the DA’s Office.
